Limited Lifetime Warranty

Bench Dog, Inc. backs its tools with a limited lifetime warranty. If a Bench Dog product fails to perform its intended purpose, under normal usage, due to defects in material or workmanship, the tool will be repaired or replaced at our option. This warranty excludes warranties of fitness for a particular purpose. Products that are worn from normal use, or damaged due to accident, abuse, neglect, or modification are not covered by the warranty. When possible, products not covered under warranty will be repaired for a reasonable charge. This warranty does not cover economic loss, consequential damage or cost of injury. Tools for warranty consideration should be returned to the point of purchase within 30 days of discovering the defect. We reserve the right to make product changes without notice and without obligation to make these changes on products previously sold.

Order Changes or Cancellations

You may request that we change or cancel your order as long as we have not processed your order already. Do not request order cancellations via e-mail as they may not be received in time. Please direct all changes to 800-786-8902. We can not guarantee changes or cancellations to orders once the order has been submitted by you. If the order has been processed, your only recourse is to request an RMA.

Return of Nondefective Items

Bench Dog, Inc. offers a 100% return guarantee within 7 days of delivery as long as the item purchased remains in new, unused condition. Return requests after 7 days up to 14 days will be honored only if the item is in new condition and has all documentation, packaging and parts. Returns in the 8 - 14 day period will be charged a 20% restocking fee. Used items, or items missing any of the above are not returnable after 7 days. Request a return material authorization (RMA) Items returned without an RMA # are subject to return at the sender's expense or will be assessed a 20% restocking fee. RMA #s are valid for 14 days. Items refused for shipment are considered an unauthorized return and will be assessed a 20% restocking fee.

Restocking fees are not negotiable by members of our staff.

Return packages must be sent prepaid shipping. COD packages will not be accepted. Shipping costs are excluded from any refund of purchase. Under NO circumstances will returns or cancellations be accepted for special order items.

Privacy

Your e-mail address and telephone number along with your address will be provided to the agent shipping your package to help ensure correct delivery. Bench Dog may also provide your e-mail and telephone number to vendors that are drop shipping items on your behalf or who are responding to your request to us for information about Bench Dog products. Bench Dog DOES NOT sell your personal information.

Price Matching

Bench Dog, Inc. does not offer a price matching policy. We post our current retail price on the web site for all retail customers. PRICES ARE NOT NEGOTIABLE.

Resellers & Distributors

Resellers and distributors should contact Bench Dog directly and request a credit application.

We do not guarantee that any reseller listed on our site will be "in stock" on any of our products or have the best price, and make no other representations regarding these independent resellers, their policies, or their websites.

Disputes

Any dispute relating in any way to your visit to Bench Dog, Inc. or to products you purchase through Bench Dog, Inc. shall be submitted to confidential arbitration in Minneapolis, Minnesota except that, to the extent you have in any manner violated or threatened to violate Bench Dog, Inc's intellectual property rights, Bench Dog, Inc. may seek injunctive or other appropriate relief in any state or federal court, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Policies, Modification, and Severability

We reserve the right to make changes to our site, prices, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. We reserve the right to deny any sale at our sole discretion.

Risk of Loss

All items purchased from Bench Dog, Inc. are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. We will only ship with registered carriers such as UPS, USPS, or SpeeDee. Items may be shipped via the United States Postal Service Priority Mail or Air Mail at the customer's request (with the exception of APO & FPO shipments). Purchases shipped by the Postal Service (or any other non-registered carrier), are shipped at the customers sole responsibility. Bench Dog will only assume responsibility for delivery to the post office.

Back Orders and Ship Time

Items may not be in stock when your order is received. You were likely given a target ship date if you called in your order. This is our best estimate and is not a guarantee. Please provide your e-mail address for notice of products that are not available for shipment within 30 days of your order.

Customers requesting shipment by USPS, DHL, Airborne or any carrier other than our standard UPS or SpeeDee Delivery will automatically add 1 business day to the ship time of their order.

Duties and Additional Charges

Items returned to Bench Dog by the shipping carrier as a result of customer error, or inability for the carrier to make delivery to the address provided will be the responsibility of the customer to pay for return shipping of the carrier to Bench Dog. This will be charged to your on file credit card. If the error was on the part of Bench Dog, we will cover return shipping charges to us and back to you again.

If the customer provides an incorrect or incomplete address, the customer may be assessed a $5.00 address correction charge as imposed by UPS, or whatever charge is imposed by your selected carrier. This will be billed to the customers on file credit card. This only applies to errors made by the customer.

Returned checks that have not been honored by the customer's bank fall 100% to the responsibility of the customer. All returned checks fall under the jurisdiction of the laws for the State of Minnesota and will be assessed a $25.00 or 5% service fee, whichever is the higher. Bench Dog, Inc. will take any and all measures to ensure returned checks are paid. This includes but is not limited to charging previously used charge cards and legal action. Use of a check to pay for services constitutes your agreement to these terms.

In some situations Bench Dog, Inc. may be charged duties by your local government for international shipments. Typically UPS or FedEx or any other courier used will collect this from you at the time of delivery. However sometimes they are unable to do so for any number of reasons and we are charged duties for your package. In this event, we will pay the duties owed. However your on file charge card will be used to pay these taxes. The amount of any such charges will be the exact dollar amount charged by the carrier to us. When this occurs you will be notified by mail and a copy of the customs charges will be attached.

Return of nondefective items will also result in a charge.

Product Descriptions

Bench Dog, Inc. attempts to be as accurate as possible. However, Bench Dog, Inc. does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Bench Dog is not as described, your sole remedy is to return it in unused condition. All prices are in US dollars and are subject to change. Bench Dog reserves the right to make product modifications and improvements without notice and to correct errors in product descriptions and prices.

Applicable Law

By visiting Bench Dog, Inc. you agree that the laws of the state of Minnesota, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Bench Dog, Inc. or its affiliates. It is agreed that soul jurisdiction for any disputes or legal actions between Bench Dog, Inc. and any other party does reside with the court system in Hennepin County, in the State of Minnesota.
